Welcome to the Mountain Shadows Resort Community and to the Mountain Shadows Resort Homeowner’s Association (MSRHOA). Whether you have just bought a lot or you have bought an existing cabin, you are entitled to all of the privileges of full membership in our HOA.
Per your GENERAL WARRANTY DEED, the conveyance of the lot was made subject to the covenants, restrictions, easements, rules and regulations governing the Mountain Shadows Resort Community as established by its Declaration and Bylaws. https://msrhoa.com/Documents/
The Association has one general membership meeting each year. See “Events and News” for time and date.
The Board of Directors meets at least four times per year and is responsible for carrying out the motions and suggestions of the general membership. The board also compiles a budget and presents it to the general membership for approval during the annual meeting.
Upon request, any HOA member may obtain a copy of the minutes from the executive board meeting or general HOA meeting for the past two years. Please contact the President and/or the Secretary of the HOA to make your request.
The “Declaration of Covenants, Conditions, Restrictions, and Easements for Mountain Shadows Resort L.L.C.” is on file at the Sevier County courthouse. This document is public record and as a member of the HOA, you are obligated to abide by its regulations. The documents along with policies and other informations are available under “Documents” for reference only.
Billing: You will be receiving a bill from the HOA each month which will include the following:

Monthly Dues - $80/month (33.33% per month for unimproved properties or properties currently under construction as stated in Policy 12)

Water/Sewer Bill – Each month MSRHOA pays the water/sewer bill for the entire resort directly to the City of Gatlinburg. A staff member from the HOA management will read each cabin’s meter. The HOA bills the individual cabin owners for their cabin's usage.

Yearly Assessment - Provides funds for the Operating Account. The amount per membership is determined by the executive board as needed.

Special Project Assessment - Provides funds for Special Projects. The amount per membership is determined by the executive board for projects within the resort.

Past Due Collections: In order for the resort to be properly maintained and managed, it is imperative that the members of the Association are responsible and diligent in paying their dues and fees in a timely manner. The HOA relies on the fees and assessments to stay operational.
Payments not postmarked by the due date of your HOA invoice will be charged a late payment and service charge. It will be added to your next invoice and your water will be subject to disconnection. If the water is cut off, there will be a $150.00 reconnection fee that must be paid, in addition to the original invoice amount and late payment, before the water will be turned back on.
If you have a special circumstance, please contact the President or Treasurer to possibly avoid a disconnection of your water service.
If an owner becomes deliquent in their account, the HOA has the legal right to file a statement of lien against the property. Within 30 days of that filing and mailing of notice of lien (pursuant to Section 4.8.6 of the Declaration), the HOA may foreclose on the lien.
Change of Ownership: You must notify the HOA if you list your cabin for sale (please send an email to MSRHOA and include your real estate agent's information) if you list your cabin for sale. Upon transfer of ownership of a cabin, the BUYER is required to pay $525.00 to MSRHOA as well as the accounting firm fee to cover the changing of ownership records and providing closing cost information. All outstanding monies owed to the HOA must be paid in full before or at closing on a property.
